What is the standard for 1st Amendment Redress against attorneys with the Kentucky Bar Association?  Well looking at what what the KBA did in 2007 to attorney John Berry, you would think it is really tough in Kentucky for attorneys.

In 2007, attorney John Berry wrote a truthful letter critical of the Legislative Commission Ethics Committee handling of a case.  He received a warning letter that he was in violation of the Kentucky Supreme Court Rules for telling the reckless truth.

In 2007, I also wrote a complaint to the Kentucky Bar Association against Pike County Attorney Howard Keith Hall.  I explained to the KBA that Hall refused to prosecute child support against attorney Jonah Lee Stevens, his personal friend for nearly a year.  Then, after I wrote a complaint to the Attorney Generals Office about Hall;  Hall on the next business day had his office type up a malicious one sentence warrant for my arrest and the allegation didn't even take place within Hall's jurisdiction.

The Kentucky Bar Association wrote that Halls actions were okie dokie.  In fact, the KBA said the complaint did not state an ethical which "required investigation".  Let me such say this, not every member of the KBA is a bad guy- this just shows that someone within the KBA is screening complaints on political basis.  This is a very dangerous precedent for both members of the KBA and private citizens.

Okay, lets break this down.  IN KENTUCKY, an attorney telling the truth is attorney misconduct but an attorney that engages in conflict of interest to both 1) not prosecute child support to protect his friends and 2) then maliciously criminally prosecute after a complaint- that is attorney misconduct that does not "require investigation"???

In June 2005, I applied for child support prosecution against attorney Jonah Lee Stevens with the Howard Keith Halls child support office in Pike County.

In June 2006, I filed a complaint against Howard Keith Hall for not prosecuting his friend, attorney Jonah Lee Stevens for child support explaining the official misconduct crime to the Kentucky Attorney Generals Office.  What I didn't know at that time is that Howard Keith Hall was a campaign contributor to the Attorney General and the Attorney General doesn't prosecute campaign contributors.

Howard Keith Hall received notice of the complaint on Friday, June 9, 2006.  Hall admitted that his office type up an arrest warrant for Amy Mischler in a letter signed personally by Howard Keith Hall.

When did Howard Keith Hall's office type up that warrant?  He typed it up Monday, June 12, 2006.  AND Hall falsified the location of the alleged crime as Pike County within his jurisdiction, although everyone in Pike and Floyd Counties knows that Boldman Freewill Baptist Church is located in Floyd County.  Which is why Hall intentionally left off the name of the church and only typed "at the church".

At the preliminary hearing, Trooper Ryan Hamilton testified that he did not know any of the facts of the arrest warrant and that he did not know the name of the judge who signed the arrest warrant.  Well, how can  Trooper Hamilton not know the name of the judge who signed the warrant if Hamilton took the warrant to the judge as Hall's letter states he did?

Well that is because Trooper Hamilton signed the warrant after Trial Commissioner Fred Hatfield signed the warrant typed up by Hall's office.  There are other significant legal issues with the warrant not the subject of this posting.

In Pike County, trial commissioners are not members of the Kentucky Bar Association, they are political appointees.  So the judges never get personal blame for the "dirty deeds" signed off by individuals, given judicial power who do not even have law degrees.

This is clearly a malicious prosecution with multiple layers of conflict of interest by Pike County Attorney Howard Keith Hall.  Is this an ethical violation?  Yes, but why didn't the Kentucky Bar Association do something in 2007 about Howard Keith Hall instead of spending hundred of thousands of dollars going after a truthful statement by John Berry, which ultimately the KBA lost in the sixth circuit?

An attorney/prosecutor who abuses the criminal justice system to retaliate is a much worse ethics violation than any allegations the KBA has brought against John Berry, Eric Deters, or Stan Chesley.  Now that there are allegations surfacing that former KBA Chief Disciplinary Officer Linda Gosenll may have received money from the Phen-fen case and that the charges against Stan Chesley were instigated by Gosnell to possibly hide her involvement.  The question must be asked.

Oh, and the criminal charge against me?  The Pike County Grand Jury refused to indict me after I testified before them and told them what was going on.  Commonwealth Attorney Rick Bartley who stayed in the grand jury room despite my putting on the record his conflict of interest of being very good friends, with one of the witnesses against me, my ex husband- attorney Jonah Lee Stevens;  Bartley refused to allow me to give testimony to the Grand Jury about the crimes committed against me by Hall, Stevens, and others.
